MAYES COUNTY

Public Defender

Heading

Misty Fields has been the Mayes County public defender since 2015 and the Delaware Public Defender since 2019.  While the job of indigent defense for two counties is a huge responsibility, Fields loves the work and prides herself on breaking the "public defender" stereotype while providing high quality representation to the counties' indigent defendants.

When a person is charged with a crime, they will usually need an attorney.  If the accused cannot afford a privately hired attorney, they usually apply to the Court for a court appointed attorney, or public defender.  In every Oklahoma County except Tulsa and Oklahoma counties, the attorney appointed to represent indigent criminal defendants' contracts with the Oklahoma Indigent Defense System [OIDS] and is commonly referred to as the "OIDS attorney."

If the accused meets the criteria to receive a court appointed attorney, the Court will sign an order directing that OIDS is appointed to represent the defendant.  At that point, the defendant becomes a client of Fields and Garner just as any other client.  Upon receiving notice of the appointment to a case, a staff member of the firm will make contact with the client to collect basic information about the client and perform a conflict check of the client's case.  If no conflict of interest is found, Fields and Garner will begin representation by filing initial pleadings in the matter and reaching out to the District Attorney to initiate plea negotiations.

People who are court appointed for representation by Fields and Garner should note that, due to the large case load of the OIDS contract, the attorneys and their staff follow a rigid system to ensure that all clients receive the highest quality representation possible.  Things that the client can do to assist in their defense are as follows: be patient and know that the firm is working on their case; keep Fields and Garner informed of the client's up-to-date contact information; attend all meetings that are scheduled between the client and the attorney or staff; and bring a list of any questions that the client has to all meetings in order to maximize efficiency of the meeting.

Misty Fields has been described as having the heart of a criminal defense attorney, and this description embodies the passion with which she approaches her criminal defense practice regardless of whether the client is court appointed or private.  It is the mission of Fields and Garner to ensure that every criminally accused person is afforded each of their Constitutional rights and that those rights are protected to the fullest extent of the law without regard to the clients' economic status or situation.
